SG Mehta, submitted to the Supreme Court that the board had filed an affidavit taking into account state reports. The board has essentially agreed not to administer the July 1 exams. Speaking in court, SG said, "Our affidavit filed half an hour ago states that the examination for Class 10 and 12 from July 1 stands cancelled, taking into account suggestions from States."

He has also added that all Class 10 examinations have been cancelled. Class 12 examination is however optional. "CBSE has a system in which the marks received in the previous 3 exams will be taken into account; for Class 12, the examinations will be carried out 'as long as the situation is favourable. Marks will have such marks as final marks for the students who opt for Class 12.

CBSE Class 12 students will have to share their decision as to whether to apply for the exam at a later date or accept the marks based on the three previous exams, as the student scored. The Supreme Court ordered CBSE to reword its reply to ensure that the minds of the student and the parents are not disturbed.

The ICSE Board (CISCE) has agreed to follow the recommendation of CBSE and to cancel the ICSE, ISC Exams due in July. Unlike CBSE, however, the board will not be offering the Class 12 students an option to appear later for the exams. CBE Board Exams: A timeline of events

Few CBSE 10th, 12th Board Exam papers were left in 2020 when the schools and colleges were closed. Exams were deferred till April from March 19 to March 31, and then postponed by the HRD Ministry as a nationwide lockdown was declared on March 25. Such exams were then postponed, and were expected to take place between July 1 and July 15.

CBSE expressed its intention to cancel the examinations abroad and to carry out examinations for only 29 subjects out of the remaining set. The board published the date sheet for the May exams. However, parents were swift to oppose the move. Concerns rose as the COVID19 cases spiraled through the world. India currently has 4.73 lakh cases. According to the most recent newsletter, India reported 4,73,105 positive cases including 1,86,514 active cases, 2,71,697 cured / discharged cases and 14,894 deaths.

Due to the particularly severe pandemic situation in Delhi and Mumbai, which incidentally also has a large number of CBSE students, the discomfort has increased as the dates have come closer. SC had then asked CBSE, taking cognizance of the PIL filed, to 'reconsider' its decision to conduct the exams in July.
